Terms of Service

These Terms are an agreement between you and Capsubs ("Capsubs", "we", "us"). By creating an account or using capsubs.com, the Capsubs app or the API (the "Service"), you agree to them. If you don't agree, don't use the Service.

You must be at least 13 years old to use Capsubs. To buy a paid plan you must be 18 or have a parent or guardian's permission.

Capsubs adds AI-generated captions (and, on paid plans, AI voiceover) to videos you upload. We may add, change or remove features, plan limits or the free plan at any time.

You are responsible for your account and everything done with it, including keeping your password and API keys private.

You own it: Your videos and the captioned videos you download are yours. You give us permission to store and process them, including through our service providers, only to run the Service for you.

You need the rights: You confirm you have the right to upload each video and to have it captioned or voiced, including the consent of anyone who appears or speaks in it.

We don't keep it: Videos are deleted 7 days after upload. Download what you need. Capsubs is not a backup or storage service.

Don't use Capsubs to:

• Upload anything illegal, or anything that infringes someone else's copyright, privacy or other rights

• Upload any content that sexualizes minors, or sexual content of anyone without their consent

• Harass, threaten or defraud anyone, or create deceptive content that impersonates a real person

• Get around plan limits, share accounts, or overload, probe or reverse-engineer the Service

• Resell or repackage the Service without our written permission

We may remove content and suspend or close accounts that break these rules, without a refund.

Captions, transcripts and voiceovers are produced by AI and can be wrong, including names, numbers and words that change the meaning. Review every video before you publish it. You are solely responsible for what you publish.

Automatic renewal: Paid plans are billed monthly in advance and renew automatically each month at the price shown at checkout, until you cancel.

Cancel anytime: Cancel online from the Billing page in your dashboard. Your plan stays active until the end of the period you paid for, and you won't be charged again.

Refunds: Payments are non-refundable and we don't give partial refunds, except where the law requires. If a video fails to process, it doesn't count against your plan.

Price changes: We'll tell you before a new price applies to your plan, and you can cancel before it does. Taxes may be added where required.

If you believe content processed on Capsubs infringes your copyright, email support@capsubs.com with the details. We close the accounts of repeat infringers.

You can stop using Capsubs at any time and ask us to delete your account. We may suspend or close your account at any time if you break these Terms or misuse the Service. The sections on your content, AI output, disclaimers, liability and indemnity continue to apply after your account ends.

YOU USE CAPSUBS AT YOUR OWN RISK. THE SERVICE AND EVERYTHING IT PRODUCES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT YOUR FILES WON'T BE LOST.

TO THE FULLEST EXTENT PERMITTED BY LAW, CAPSUBS IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, CONTENT, FOLLOWERS OR REPUTATION, ARISING FROM YOUR USE OF THE SERVICE OR ANYTHING IT PRODUCES.

OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50.

Some places don't allow some of these limits, so they may not all apply to you.

You agree to cover any claims, losses and costs (including reasonable legal fees) brought against Capsubs because of your content, what you publish, or your breach of these Terms.

We may update these Terms. If a change is significant we'll tell you by email or in the app; using the Service after a change means you accept it.

These Terms are governed by the laws of the State of California. If any part is found unenforceable, the rest still applies. Questions: support@capsubs.com.
